By accessing this website, you are agreeing to be bound by these web site Terms and Conditions of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this website are protected by applicable copyright and trade mark law.
We reserve the right to refuse service without disclosing a reason. All prices are subject to change without notice, no adjustments will be made.
ORDER APPROVAL
Customer is fully responsible for final proof and layout approval prior to finalizing files. Kris Norris is not liable for errors in a final design caused by any of the following reasons: misspelling, logos, graphics, grammar, punctuation or content.
By approving an order you are agreeing to the following: I have verified that spelling and content are correct. I am satisfied with the document layout. I understand that my document will print (when ordering print flat) and/or appear digitally as it appears on the proof.
Mistakes found after the final version has been delivered are subject to a $25.00 processing fee.
APPROVED DESIGN USAGE
We reserve the right to use any artwork created by Kris Norris in our online and offline portfolios, company website graphics or promotional graphics for the purpose of advertising our services. If you do not want your design displayed, please notify Kris Norris before the final version is accepted. If you want an image removed from our online portfolios, please contact Kris Norris via email. If you have a release date you wish honored please let us know. Requests will be respected.
Since each design is unquie to the user and has no resale value, all sales are final.
Kris Norris reserves the right to use any unordered design for future projects or promotional purposes.
CUSTOMER CONTENT
You understand that all information, data, text, photographs, graphics, messages or other materials (“content”) are the sole responsibility of the person from which such content originated. This means that you, and not Kris Norris, are entirely responsible for all content that you send, upload, or transmit for your order. Any images purchased by Kris Norris are from stock image sites and are the property of Kris Norris. If you wish to retain rights of the images, you are free to purchase them, yourself. High resolution copies must be forwarded to Kris Norris for the sole purpose of creating the approved cover. Any images purchased by the you will be at your own expense and will not be deducted from the price of the cover.
COPYRIGHT
You may not place or reproduce any trademarks, service marks, or logos that are not owned by you or licensed to you onto materials and merchandise to be printed or designed by Kris Norris. Words, names, and designs used to identify services or products are considered trademarks, service marks, and/or logos. The same policy is applicable for copyrights. You cannot use unlicensed copyrighted materials from photographers, artists, publishers, composers, writers, and other authors of original works. The copyright owner’s exclusive rights prohibit the reproduction of any original work.
DISCLAIMER
The materials on Kris Norris’s web site are provided “as is”. Kris Norris makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, Kris Norris does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its Internet web site or otherwise relating to such materials or on any sites linked to this site.
LIMITATIONS
In no event shall Kris Norris or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on Kris Norris’s Internet site, even if Kris Norris or a Kris Norris authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
INDEMNITY
You agree that you shall indemnify and defend Kris Norris and all parties from whom Kris Norris has licensed portions of content, and their directors, officers, and employees, against all claims, liability, damages, costs and expenses, including reasonable legal fees and expenses arising out of or related to (I) your breach of these terms of use or (II) any suit, claim, or demand arising from or relating to any text, photograph, image, graphic or other material you incorporated into designs.
CUSTOMER SUBMITTED ARTWORK OR GRAPHICS
All artwork, designs and images must be provided in minimum of 300 DPI. Kris Norris is not responsible for images printed as fuzzy, distorted or pixelated due to customer provided artwork. All printed orders are converted from RGB and printed in CMYK.
COLOR PROOFING AND MATCHING
Kris Norris is not liable for color matching on electronic proofs approved by the customer. Electronic proofs will predict design layout, text accuracy, image proportion and placement, but not color or print quality.
Every effort will be made to match the gradient density of each color. However, Kris Norris is not liable for the final appearance of a color.
ORDER CANCELLATION
Kris Norris will be happy to help you cancel your order prior to approval. Kris Norris will inform you of any cancellation charges depending on the stage of the order. If job is canceled any labor hours (proof, graphics design, etc.) can be subtracted from your refund.
REVISIONS AND ERRATA
The materials appearing on Kris Norris’s website could include technical, typographical, or photographic errors. Kris Norris does not warrant that any of the materials on its web site are accurate, complete, or current. Kris Norris may make changes to the materials contained on its website at any time without notice. Kris Norris does not, however, make any commitment to update the materials.
LINKS
Kris Norris has not reviewed all of the sites linked to its Internet website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Kris Norris of the site. Use of any such linked website is at the user’s own risk.
